CONDITIONS OF HIRE
The contract of hire is between the holidaymaker (who represents all parties staying at the property) and Darren Glen & Liz Hogarth, The Homestead, Limeburn Hill, Chew Magna, Bristol, BS40 8QR and is bound by all conditions of hire herein. The contract is effective once the holidaymaker has received written confirmation of the booking to let the self catering accommodation at 11 Scott Court, Whitehall Landing, Whitby, North Yorkshire YO22 4FE.
Bookings can be requested via the website, phone, fax or email. The holidaymaker will receive a booking confirmation. A non-refundable deposit of £100 is payable immediately on booking. 8 weeks before the arrival date, the remainder of the full fee becomes due. In the case of bookings made within 8 weeks of arrival, full payment is required immediately. A booking is confirmed in writing or by email to holidaymaker. A booking cannot be confirmed until the deposit has been received. Where an initial request is made and the deposit is not received within 7 days the self catering accommodation can be booked to someone else.
AVAILABILITY & PRICES
Availability of particular slots for 11 Scott Court, Whitehall Landing and respective prices are subject to confirmation and can be different to those publicised on the web site.
OCCUPANCY OF THE PROPERTY - 11 Scott Court, Whitehall Landing, Whitby, North Yorkshire YO22 4FE.
The holidaymaker will make known the number of people within the party staying at the self catering accommodation. This number will not be increased without the prior knowledge and agreement of Miss Hogarth or Mr Glen. Miss Hogarth and Mr Glen have the right to refuse entry to the property should the number of people within the party exceed the maximum number. In this instance this will be considered a breach of contract.
If a rent booking is cancelled by holidaymaker then an attempt will be made to re-book the slot within 11 Scott Court, Whitehall Landing, Whitby. If this is possible then the holidaymaker will receive payment made less the deposit back. If this cannot be achieved then the holidaymaker is not entitled to a refund. If Miss Hogarth or Mr Glen cancels the booking, a full refund will be given. In the event that a booking has to be cancelled by Miss Hogarth or Mr Glen, the full refund will be made but thereafter holidaymaker will have no further claim against Miss Hogarth or Mr Glen.
The holidaymaker is responsible for holiday insurance to cover all parties using the property. This includes personal insurance, including cancellation insurance and personal effects. Miss Hogarth is not liable for loss of any personal effects or personal injury whilst on the the premises.
Every care has been taken to ensure that the safety of the holidaymaker is catered for. Nevertheless, the holidaymaker should exercise caution and adequate supervision where necessary to prevent injury or damage. If holidaymaker has any concerns over safety, this should be reported to Miss Hogarth or Mr Glen immediately.
UPKEEP OF THE PROPERTY
The property is maintained to a high standard and is well equipped and the holidaymaker must ensure that it is kept clean and tidy and care is taken not to damage the property or its contents. All damages must be reported to Miss Hogarth or Mr Glen immediately and must be paid for. This property is strictly NO SMOKING and the holidaymaker is therefore agreeing to no smoking within the property. The holidaymaker is also accepting that no pets are allowed within the property.
ACCESS TO THE PROPERTY BY MR GLEN/MISS HOGARTH
Access to 11 Scott Court, Whitehall Landing, Whitby can be made by Mr Glen/Miss Hogarth provided reasonable notice is given under normal circumstances. Mr Glen/Miss Hogarth can access the property immediately should it be an emergency.
Facilities are expected to be as described on the web site with the possibility of small exceptions. All bed linen is supplied free of charge. No towels are provided. Electricity is free of charge.
Should qualified complaints be made against the holidaymaker, this will be considered as breach of contract. Should holidaymaker wish to make a complaint, this should be made to Mr Glen/Miss Hogarth immediately in an attempt to resolve the problem.
Arrival day is on a Friday for all weekly and weekend bookings unless alternative arrangements are agreed betwen holidaymaker and Mr Glen/Miss Hogarth. For those bookings made which are not weekend or weekly, Mr Glen/Miss Hogarth will agree the arrival day with the holidaymaker. Check in time is after 3pm on the day of arrival and check out time on the day of departure is strictly 10am. Holidaymaker will be met by a representing agent on arrival.
BREACH OF CONTRACT
Should the holidaymaker be in breach of this contract at any point, or be suspected of being in breach of contract, Mr Glen/Miss Hogarth has the right to enter the property and request the holidaymaker to leave. In such circumstances a refund will not be given.
